TERMS AND CONDITIONS

All orders are accepted on the clear understanding that these Terms and Conditions shall apply.


PAYMENT

1.Unless otherwise stated prices are based on costs current at the date of the quotation and are subject to variation with any change in costs.

2.Quoted prices hold good for the quantities stated in quotation and are subject to revision if the quantities change.

3.Quoted prices hold good for the colour and sheen specification in original quote and are subject to revision if the colour or sheen change.

4.Orders and quotations based solely on the project drawing, plan, specification or photographs, can be subject to price variation at the time of the receipt of the goods by the Company.

5.Unless otherwise specified, quoted prices exclude collection and delivery to the customer's premises, unloading and installation as appropriate.

6.Unless otherwise specified, quoted prices exclude packaging of the goods.

7.Unless otherwise agreed all invoices shall be payable in full upon receipt or upon the collection of the goods, whichever is earlier.

8.The Company reserves the right to hold the goods until the invoice is paid, and charge the Customer for the cost of storage.

9.Interest will be charged daily on overdue accounts at 5% of the amount on the invoice.


DELIVERY

10.The company shall not be responsible for any loss or damage of the goods caused by delivery / collection, performed by courier company or customer.

11.Whilst every effort will be made to complete the order within the specified agreed time, under no circumstances can liability be accepted for any delay in completion of the contract caused by delay in delivery of the goods to the Company.

12.If the Customer fails to collect or fails to take delivery of the Goods on the agreed date, then, the Company may store the goods until next collection / delivery is arranged and charge the Customer for the reasonable costs of storage.


ORDERS AND CANCELLATION

13.Orders placed cannot be cancelled, without the Company's consent and the Customer will be responsible for covering the cost of the paint ordered by the Company.

14.The Company reserves the right to cancel the order if the goods do not comply with the original order.

15.Orders and quotations based solely on the project drawing, plan, specification or photographs, can be subject to price variation at the time of the receipt of the goods by the Company.

16.The Company will perform only the work which was ordered and specified by the Customer, and shall not be held responsible for any unsprayed areas, if not previously instructed by the Customer.

17.The Customer shall be charged by the Company for any alterations to original order, in terms of colour or sheen of the paint, if such has already been ordered.

18.Whilst every effort will be made to complete the order within the specified agreed time, under no circumstances can liability be accepted for any delay in completion of the contract caused by the any alterations made to the original order by the Customer.

19.The Company shall not be liable to the Customer or be deemed to be in breach of the Contract by reason of any delay in performing or failure was due to any cause beyond the Company's reasonable control but not limited to the acts of God, war, statutory or other government restrictions, strikes or any industrial action, difficulties in obtaining labour or materials and breakdown of machinery.

20.The Customer is responsible for inspecting the goods before accepting the goods from the Company. If the goods are accepted and delivered by Company/collected by the customer in person, the Company shall have no liability for any claim in respect of any defect in the goods, which would be apparent on inspection and which is made after delivery/collection or in respect of any damage during transit, if collected by customer.

21. If the Customer is not satisfied with the work performed by the Company, the concern must be addressed to the Company, at the time of delivering/collecting the goods, and left at the Company for re-spraying. If the Customer decides to take the goods notwithstanding the concerns, the Company have no liability for any claim in respect of the goods.


DAMAGED GOODS

22.The Company shall not be held responsible for performing any repairs to the goods before or in the process of spraying, unless otherwise agreed.

23.The Company is not obliged to accept the goods damaged or in any way altered by the customer (after original order has been completed) for re-spraying.

24.The Company shall accept the damaged or in any way altered by the customer goods for re-spraying (after original order has been completed)only at the Company's discretion, and charge the Customer for such work accordingly and separately to the original order.
